Trademark Usage Guidelines
Traxxas Trademark & Brand Policy
Purpose: These are Traxxas’ brand use guidelines, which explain how you may use Traxxas’ brands correctly. Traxxas’ trademarks are protected internationally and include trademarks and registered trademarks as listed below and other logos, symbols, icons, graphics, phrases, taglines, trade dress, or images that identify the source of origin of Traxxas’ products and services (the “Traxxas Trademarks”).
Background: Founded in 1986, Traxxas is a well-established company that has had a significant impact in shaping and leading the RC Industry. Traxxas is unique in the RC industry for its significant and enduring investment in engineering resources that drives the innovative and high-quality products customers expect from Traxxas. Traxxas’ industry-leading engineering and innovation has been awarded numerous patents and trademarks. The popularity and visibility of the Traxxas brand in the marketplace sometimes invites abuse and misuse of Traxxas intellectual property. The types of abuse can range from scam websites and deceptive misuse of trademarks to blatant copies (knock-offs) of intellectual property. Traxxas employs numerous methods, including third party web scanning services, to protect our customers and the RC industry from these abuses. Every situation is different, but sometimes enforcement actions can have significant consequences ranging from lawsuits to violations of a web host’s terms of service that could lead to an interruption in web hosting services. Most often, Traxxas endeavors to reach out, correct issues, and change a course of action to help educate and avoid legal or other consequences.
- Fraudulent websites: Traxxas employs third party web and marketplace scanning to search out and take immediate enforcement action against websites that use Traxxas trademarks to fraudulently misrepresent Traxxas product to scam customers out of their money, credit card information, and other personal information. These destructive websites often advertise Traxxas products at “too good to be true prices” and are dangerous and misleading for our potential customers.
- Copies of Traxxas Intellectual Property: Traxxas does not license its intellectual property for third party use in manufacturing. Making and selling products using Traxxas Intellectual property without license or permission is theft and subject to severe prosecution and penalties. Traxxas is committed to vigorously defending its valuable intellectual property. Manufacturers that copy another manufacturer’s intellectual property do not add any value or innovation to the RC industry. It is theft, plain and simple.
- Trademark Abuse: Intellectual property law in most jurisdictions allows good faith, fair use of trademarks in commerce by resellers of products. Traxxas supports this in many ways, including supporting the aftermarket industry that supplies unique and exciting products for RC enthusiasts to customize and enhance their products for specific uses. However, to prevent misleading customers and causing confusion in the marketplace, established fair use rules and standards must be followed. Customer confusion occurs when a product title, description, or image is unclear about who manufactured a product that is intended to fit a specific model. Traxxas parts and accessories are engineered to the same high standards as Traxxas models, and attaching a Traxxas label to an accessory in the marketplace equates the product with Traxxas engineering and quality. Attempting to brand an item not manufactured by Traxxas as a Traxxas item causes customer and brand confusion in the marketplace and damages the Traxxas brand. Not all accessories are created equal. Proper fair use of trademarks is important to help customers clearly understand what they are buying and who made it. Traxxas understands and appreciates support from resellers and the aftermarket and is happy to discuss the proper use of Traxxas marks in marketing their products and services. This helps avoid violations and the possibility of some type of trademark enforcement in the future.
Brand Use Guidelines:
For Traxxas resellers and the aftermarket, the following are some general brand use guidelines for Traxxas Trademarks. For more detailed information, you may contact us directly at trademarks@traxxas.com. We are happy to support your efforts to avoid customer confusion.
Do's
- You may make factual, truthful statements about how your product works with or is made to be used with a Traxxas product.
- Your product name should include its own brand name and should not advertise the product as a Traxxas brand (e.g., Bob’s bearings for TRX-4, or fits TRX-4, and not TRX-4 bearings).
- Use the plain text for Traxxas, not the logo.
- If you are a Traxxas dealer, use Traxxas supplied images, or your own images of the Traxxas product to help you market and sell a specific Traxxas product.
- If you are showing an aftermarket product not made by Traxxas on a Traxxas model using your own and not Traxxas images, make sure it is clear to potential customers that the highlighted aftermarket parts are not manufactured by Traxxas.
- Avoid trademarks, company names, product, or feature names, domain names, or social media handles that are confusingly similar to the Traxxas Trademarks.
- Give proper trademark credit to Traxxas if you use Traxxas brand (e.g., Traxxas® or TRX-4® is a registered trademark of Traxxas, L.P.).
- If you truthfully state your product can be used with, is for, or compatible with a Traxxas product, use the following text on every page where it can be seen by someone purchasing such an item: “This product or service is not affiliated with, endorsed by, or associated with Traxxas, L.P., or its products and services. Traxxas® and [insert the product trademark here (e.g., X-MAXX®)]® are trademarks or registered trademarks of Traxxas, L.P.”
Don'ts
- Do not use Traxxas Trademarks as part of your company, product, or service name.
- Do not use or display the Traxxas Trademarks more prominently than your company, product, or service name.
- Do not create the impression that Traxxas endorses, sponsors, approves, or is in any way associated with your product or service.
- Do not use Traxxas’ stylized trademarks (i.e., logos) or Traxxas images for a non-Traxxas product.
- Do not use Traxxas Trademarks in any way that would be misleading to consumers.
- Do not use, copy, alter or imitate Traxxas’ logos, trade dress, color scheme, website, products, packaging, icons, marketing materials or photographs in such a way that violates Traxxas intellectual property rights or creates customer confusion. For example, do not design a website that copies the Traxxas website. Do not design your product packaging to look like Traxxas packaging.
- Do not use the Traxxas Trademarks on or in connection with third party accessories, apparel, or merchandise (or anything else). Merchandise includes anything you create or build such as accessories, software, apps, apparel, signs, banners, etc., for commercial purposes. We love your enthusiasm for our products but please don’t put the Traxxas Trademarks (or any variations) on your custom creations for commercial purposes.
